Hi my Husband and I had a baby a few months ago and need to create a will! How do you go about creating a will in Oz? Do we need to take it to the embassy to get notarized since we are both US citizens? anyone have an idea? thanks so much for your help! |

While you are here, you need to do one per local practises. When you move back to the US, get do one there too. You can call out beneficiaries that are not in Australia, but they will have to come here to make a claim. I wrote my own will using a template I received with an insurance policy I took out. My case is simple (no kids to name a guardian for) but the spaces were all there for that purpose and lots of other contingencies too. All I did was fill in the blanks, state "NOT APPLICABLE" in spaces that did not apply and take it to my local police office to be witnessed. Easy peasy. One of the partners of the firm I work at was a lawyer before he became an accountant, I checked it out with him and it is all perfectly legal here in Australia. Cheers, Marilyn |

We did the same: created one online with Australian Executor Trustees. They keep the originals at their offices and offer support. We also have copies in two separate places. It was pretty cheap: www.aetlimited.com.au You must update the will if you get married or have any other changes in circumstances. |

We took our US family trust and brought it to a solicitor and they took out the part that they needed and made it legal here. You don't have to have trusts unless you are a company, its pretty straight forward here. |
