hi all new to the website. in the midst of applying for offshore defacto spouse visa for myself. here's my timeline: feb 19: fbi check requested (of which i recently read may not be needed?) feb 19: state police check requested feb 26: state police check received (included in app) march 8: medical check (set to arrive 10 days following in d.c.) march 15: visa app arrived in d.c. still awaiting case officer assignation. one question though, my partner is in the u.s. currently on a 5 year tourist visa; however, he recently went to canada for a couple days and when returning to the u.s. immigration stamped his passport saying that he needed to leave by april 13. we have filled out an extension for u.s. immigration for him and wondered if it was the best move (as its $300?) or if there is another option? thanks! also a tip: beth isreal medical center in needham, mass undercuts most medical check facilities by $100 or so...... |

I would call the US immigration people about your partner's visa - we used to live close to the Canadian border and my husband has never had his Australian passport stamped for any reason. And thats a lot of money to get an extension on something that he already has? I take it that he didn't have his 5 year visa information with him or the twits at the border didn't care? Hi Shanpell we are waiting (impatiently) to hear about an offshore spouse visa, but our CO (case officer) has been very approachable and responsive when we replied to his request with a deadline for meds & pcc's as we were anxious it would expire before the FBI check came back. We waited almost 12 weeks for an FBI check, so Im interested to hear it may no longer be required, we didn't frontload our app, so it has taken a bit longer. The Embassy told me 4-6 months when I asked what time frame we were looking at. For me the process this way has been a whole lot easier than when I went through the US process. |

N400 approved Sep 2009. Australian Spouse Visa 309/100 applied for 21 Dec 2009 Medical criteria not met, so waiver application sent Medical Waived and 100 visa approved 12 July 2010 ![]() | |

thanks for all the support! we heard from u.s. immigration that as long as the visa extension is in process he is allowed to stay here under the same visa guidelines. the border officials didnt care that he had a 5 year visa, and from what i hear their word over rules previously approved visa's......so we're hoping everything is ok. haven't been assigned a case officer yet and nervous about that a bit as they have had our app for over a week. not sure if thats normal. |
