As of Friday I was granted custody by an Oregon Judge. There were two of three stages to the process the first one I initatiated I went into court without a lawyer. I got railroaded and my ex started crying and the judge warned me and told me that I need evidence. He set a continuance aside for a month later on January 22nd 2010. I hired a lawyer she sent me paperwork via e-mail to print out through the on a printer (I still dont have one). I had to have them notarized at $75 a pop here in Australia There were 6 pops, and 4 mailings at $43 express post from Tamworth. From there she was authorized to represent me. My EX hand kicked my son out after she was served with the paperwork showing I had retained a lawyer with an affidavit signed by me, which obviously pissed her off because they were truthful and obviously showed how she assaulted my son at my mother's funeral. She kicked my son out of the house and then let him back in after childrens services dropped the ball. Her grandfather let my son back into his home (who my sons mother lives with, let him back in the home where she lives as my son did not have anywhere else to go). In that affidavit She was given 30 days to respond. She never did. Due to the mail taking as long as it does and getting a notary which they dont work weekends in Australia she was given 50 days (acutually).

At the 3rd hearing my son was given a lawyer who was at first torn because of the issues of how far he would be from home, and the stress of living in a new country would incur him. Due to the fact that his mother has shown a criminal record for domestic violence against her EX boyfriend, the assault against my son, and kicking him out, and childrens services being innvolved. The judge signed the paperwork granting me custody, with my sons wishes in mind because Oregon does not have a statuatory age for children to make a choice themselves.

As I am typing this letter he got off an Alaskan Airlines flight from Portland, and boarded a flight from LAX on Delta Airlines 2 hours ago, next he will get off and board a Qantas Link flight to Tamworth. We won the fight! 15 years worth of drama! There is Karma! And it has finally ruled in my favor! I am bringing him here with a return ticket which was unbelievably cheaper to book round trip that one way. I booked him a visitors visa. I will see him here at 11am our time in Tamworth...Thanks to everyone who offered advice on Notaries, Postage Rates, and Immigration issues. We will now go from 3 kids to 4. It is the silver lining in the clouds after my mothers death. In the Default order she has no say on issuance of a passport for my son. In that order it also allows him permission to immigrate to Australia. It's done and set I am having my 4th of July tonight!

I am so happy for you and your son! Congratulations on fighting the good fight. You and your family deserve all the happiness in the world after all the stress you have endured. I hope you will share a photo of you and your son when you are able to. Hope it all goes as smoothly as possible with him getting settled in.

I'm so happy for you! I had to fight back the tears while reading this! This brings back memories of when I brought my son over. Thank God the drama is over for you guys! It's smooth sailing from here and now you all can rest easy knowing you are back together after all these years! Whew!

What a horrible story but a truly wonderful ending. You and your son are going to have the sweetest reunion when he gets off that plane and into the arms of a parent (and family) that truly loves him.
