WHV Visa Question - Who do I work for?

Quick question about a Working Holida Visa. Obviously the main restriction is that you can't work at one job for more than six months. I got a 6 month temp job at a financial company through a temp agency. Technically, I'm an employee of the agency - they send my checks, I have to talk to their HR if I have a problem, etc. But obviously I don't work at the temp agency, I work for the financial company.

My temp job here is about to end and I'm going to take a trip back to the US to visit home. When I get back, I'll be looking for a new job.

My question is, as far as the visa restriction goes, who did I just work for for 6 months? The agency or the financial company?

Obviously I'd like to use the agency again as they did a great job this time. But also, this company always has temp jobs opening and I can try and get one here when I get back. If I did that, I would be on a contract directly with the financial company. So would that be a "new" employer?

Thanks for any insight.

I've been in this situation before. You are considered to be working for the temp agency, providing a service to one of their clients (the financial company) who has contracted for workers. The financial company pays the agency for this service (sometimes called 'labour hire'), and the temp agency takes care of all the particulars - paying your salary, handling any HR issues, etc etc. On your resume, you would list the temp agency as your employer and your position at the financial company as one of the 'jobs' you did for them.

So yes, if you were to get a temp job directly with the financial company, it would be a new employer. :cheers:
