On-Shore Spouse Visa Subclass: 820 Sep 18, 2009: PMV granted! Dec 21, 2009: Request for FBI background check sent (first set expire in Feb, 2010) Mar 8, 2010: Received FBI background check May 9, 2010: Request for AFP background check sent May 19, 2010: Received AFP background check Jun 2, 2010: Lodged on-shore spouse visa at the Perth office! Finally submitting my on-shore spouse visa tomorrow at the Perth office. Hopefully the wait wont be as agonizing as it was for the prospective marriage visa! |

very very true. Have to admit that I didn't have this giant knot in my stomach when compiling application materials this time around! So I went to the office to submit my application because I wanted a receipt. They were a little baffled as to what to do with me because no one "drops off" applications anymore--they all get sent in. I am glad I went in because I ended up being assigned a case officer and meeting her on the spot. And she also pseudo-interviewed me. She was very nice. But she also said a few things that confused me. She said that since the government places a cap on temp spouse 820 visas to not expect a grant until July when the fiscal year restarts. First, I wanted to ask her why she was playing with my emotions. Because she is leading me to believe that I could be notified by July, unlike several months later that everyone else dealing with the Perth office had to wait. Also, I didn't think there could be a cap on Spouse visas. I know there can be a cap on Prospective marriage visas, but I didn't think they capped spouse visas. Anyone got a clue? |

Mine was granted in a month and it involved getting a waiver from Canberra for a missing Nicaraguan police certificate. If you did a good job prepping your application, it tends to speed things up quite considerably if you get lucky. I'd say just ignore what she said, keep expecting to wait forever and a day, and if it happens sooner, then it'll be a bonus.

Well, according to their own documentation: http://www.immi.gov.au/media/fact-sheets/21managing.htm * Partner (subclasses 309/100 and 820/801) visas cannot be capped. * Prospective Marriage (fiancé) (subclass 300) visas may be subject to capping. So your case worker is either mistaken, clueless, or was in fact playing with your emotions. ![]() I hope you don't have to wait long!

I can't stop smiling! So I called immigration today because my PMV expires tomorrow and I never got an acknowledgment letter. I wasn't quite sure if a bridging visa was granted - I needed to be sure for my own sanity. I was told "we'll follow up on this". A couple hours later I got a call from my C.O. And she said that she was just going to skip the acknowledgment letter and just send out the grant! I was quite happy with that! BUT it didn't stop there! She said based on the length of my relationship and "overwhelming evidence" backing my relationship, she was going to grant me Permanent Residency! OMG OMG OMG OMG! So I wouldn't need to do the second stage stuff. I can't believe this! edited to fix my crappy grammar Edited by meg1388, Jun 18 2010, 08:56:19 PM.

CONGRATS, meg!!! That is DEFINITELY the fastest for Perth, EVER... Mine was 6 months, and even documenting a 6-year long-distance engagement with months spent here every year, I wasn't granted PR.... Things are getting MUCH better! Lisa |

Congrats! That is fast! I've been married for 13 years and my application took nearly 5 months! Go figure... It feels like a real crap shoot but its good to hear people coming out on the good side of things!

Thanks shylady, minx, pastrycook, chocopaws, & Ambrose! Ambrose, when I dropped off my application in person I met the C.O. who told me to wait about a month for a result. I didn't quite believe it... sounded too good to be true given that others on this site seemed to wait so long for their decision. But she went on and basically said that onshore spouse visas (following a PMV) are quite easy to do because someone else (in Washington DC) has already done the hard work! Again, I didn't really believe this either. I honestly think it's just getting a good C.O. that wants to clear off their desk in a hurry! |

Wow. So I got a phone call today. I knew exactly who it was before I answered it. It was my C.O. and she has made a mistake. You guessed it. She took away my PR. She said that she granted it in error. "I spoke with my supervisors and learned that you cannot be granted permanency following a provisional visa". I've had really good experiences with the DIAC (both here and in the USA) but seriously, they need to get on the same page. I wish I would have gotten angry with her while I was still on the phone with her. I don't believe that whole "permanency cannot follow a provisional visa" thing. aren't spouses in America granted "provisional" 309 visas and then PR after that? Maybe I'm being argumentative and difficult. So I have to do all of the second stage stuff. Which is a bummer considering I've been reminding myself for the past several days that I would never have to do that again! I wish she just said "your visa has been granted" and left it at that when the C.O. called the first time. Because I would have been absolutely thrilled with that alone--15 days! But now that she's gotten my hopes up... well, damn. |

well that kinda sucks! it is very annoying that people dont know the what they are doing when its their job to know! we went round and round a few times getting different answers from different people for the same question! as for in the us, its the same as here. my hubby was given a temporary spouse visa because we had been married less than 2 years and then had to apply after 2 years for the permanent visa. when i moved to australia and applied for residency i was given permanent residency as we had been married 6 years and have 3 kids. congrats on getting your temporary residency:) |
