Bridging Visa -- do work limits reset?

I'm on a working holiday visa, and have worked 6 months at a job already. I'm about to submit an application for an 820 defacto onshore visa. My current visa expires September 8. I just called immigration and the woman I spoke to said that the 6 month work limit resets as soon as my bridging visa is granted. Is this true??? If so, it has just saved me so much stress! The job I did 6 months at would love to take me back, and I want to go back, but the window of opportunity may be shut by the time my 820 is granted in 3-6 months. I know it seems crazy to come to a message board to confirm something the actual immigration department told me, but I'm so stunned by how good this news would be that I'm afraid to believe it's true!

I'm on a WHV and submitting an on-shore spouse in a few weeks. This is my understanding as well - the bridging visa is a new visa that has the same restrictions as your substantive visa, but the time limits all magically reset.

Pretty sweet.

I am on a work and holiday visa as well and I will be applying for the 820 (partner visa) sometime in the near future. I have a question about the bridging visa if either of you can answer. When you go in to submit your application is the bridging visa automatically granted that day?? To meet the 12 month relationship requirement we have to wait until almost the day that my current visa expires :( and I was afraid that I wouldn't get that granted right away and have to leave the country! I wouldn't stay here illegally and I don't want to have to buy a plane ticket last minute either! thanks for any help on this! I wanted to file while I am in the country because my partner and I don't want to be separated for months while the whole process is taking place. thanks again for any help!

The purpose of a bridging visa is to keep you legal in the country while your application is processing... so, it will go into effect on the day your current visa expires, NOT on the day you submit the application.

Sounds like you guys are cutting it really close! I know how that goes... because I also applied the day before my tourist visa expired! :eek:
As long as you submit your complete application (and the complete fee!), you'll be OK. Fingers crossed for yas.

I'm worried about applying the day before my visa expires because Chris and I need to meet the 12 month relationship requirement. I started living with him the day I got here which would be May 7th. We knew each other for longer than 12 months but it was online through skype and fb and on the phone and I know that doesn't count. May 7th of next year is on a Saturday and the immigration office won't be open. I didn't know if they would deny us only because of being 1 day short of the 12 months because the office will be closed that day and I can't wait until the following Monday because my visa would be expired then! This is all crazy. I'm sure it would be obvious that I used the w&h visa to establish our 12 month relationship too. I don't want to get in trouble, but if it helps, I have been traveling around VIC with Chris and seeing the sites :) We were talking about doing the offshore visa but we aren't too keen on being separated for an unknown period of time while the visa is processing. He can't come back with me because of his job. He plans on coming back when my visa is approved to see my family and fly back with me. I'm not sure what to do and I don't really know if a migration agent can help. So many questions :( thanks for any help at all! I really really appreciate it!!

I was on a WHM and applied for the 820 on the very day it expired. Your WHM is valid through till midnight 12 months to the day your set foot in AUS. I was granted a Bridging visa and 2 months later got my 820, Work limits reset so i just stayed with the employer i was with on the second half of the 6months of my WHM until I found another employer. Everything went smoothly. Just make sure your apps are complete. These rules are here for a reason, but in saying that they also know who they are looking for, the fakes. Also anyone worried about the 12 month rule, you can now declare yourself as a defacto to the Aus gov and it will bypass that. there is a cooling down period and you have to do it a few months in advance.

Just to add that Relationship Registers are a state-by-state thing.. and not all states have one. Currently, it's only NSW, VIC, TAS, and the ACT. So if you're a defacto couple living in another part of Australia, unfortunately this isn't an option (yet).

Yeah, as said above, I applied for my partner visa the day before my working holiday visa expired and they rolled it over. I'm pretty sure with AUSPOST's reputation, it didn't make it there in time, but I suspect that they consider your application submitted from the post date on your package.

And yeah, going on to a bridging visa from working holiday is just like getting a second working holiday visa where the 6 month limits reset but this time you get medicare too!! :D It's super convenient that it works that way--allowed me to stay at my job for 10 months rather than 6! (4 months pre-application, 6 months post-application)

Hi Guys,

This is so good to know! I have one more question though. If work limits reset does that mean I could go back to an old job I had? I was at a place I loved when I first got here but had to leave at the end of 6 months to go somewhere else. On the bridging visa would I be able to return to that first place I was employed? Or does the work limit reset just mean you can stay longer in the job you're currently in???

I don't want to make any accidents if I'm not allowed to go back and work again for my old company ...
