Hi my name is Melody. At the moment I am here on a work and holiday visa, but I will be filling for a partner visa in May. It's a long story but my partner and I met online and dated for a long time before we actually met each other crazy I know but hey we talked all the time on skype and lots of e-mails and facebook chats. Money being an issue we couldn't fly back and forth to see each other so we decided that I would come and stay with him on a work and holiday visa. :lurve: We knew each other very well by that time but hadn't actually met in person yet. I know it's all a little crazy but I've been here since May and we are very much in love and want to stay together.
I was wondering if anyone else had ever gotten a partner visa while on a whv. I am asking because we will have to fill at the absolute last minute so that we meet the relationship requirement of 12 months and that scares me! I am already keeping a record of the things that I need, like my name being added to the gas and electric bill, a joint bank account, me paying the cell phone bill in his name, things addressed to both of us at this address my license and banking info all has this address on it too and I set up my bank account about 2 days after I got here. Does anyone know how strict they are about the 12 month requirement? I know there is a bridging visa attached to the application so if I did it on the last day I would be ok to stay in the country until the decision was made, but If we go in at 11 months and 29 days will they deny it just because of a day or 2?? I have plenty of e-mails and chats that I can print out that shows we have know each other that way before the date but I'm just not sure. :help:
I didn't want to get a tourist visa just in case it had a "no further stay" clause on it then I would have to leave the country. My partner and I wanted to do this all onshore because we don't want to be separated for possibly months while we await a decision.

ok sorry that wasn't supposed to post yet lol I'm not sure what happened. My other question was that there is a big age difference between me and my partner 19 years actually. Does anyone think that they will look closer at our application because of that? I know how people are in the US and I think that if I was trying to get him into the US they might ask more questions lol I've been reading other thread and some people have had to wait a really long time for their apps to be approved and others got them approved right away. I was hoping that I could make an appointment at our local office when the time comes and have more luck that way. I'm just really nervous about doing it at the last minute! I'm not so sure about bridging visas and how they work either.
One more question. After the temp. partner visa is granted can I fly back to the US? I wasn't sure if I was allowed to travel then, but I would like to go back so that my partner can meet my family. He has met them alll online over skype and they like him but it would be nice for them to meet face to face :)
Sorry for so many questions but if anyone can help with anything that would be great! Thanks in advance for any advice.

Hi Melody

I will bring your attention to the fact sheet on 12 month relationship requirement here: http://www.immi.gov.au/media/fact-sheets/35relationship.htm

As long as you are able to prove that your relationship is genuine and continuing, you should not have problem with age difference. Of course, the application will be closely checked but it all depends on the evidence provided.

Once the temporary partner visa is granted, you can fly back to the US. It has full work and travel rights.

Oh great thanks! We have lots of evidence, e-mails, chats, pictures, friends and family all that stuff :) What I am really worried about is going in on the last day or the last week before my current visa expires! Do you know if they give the bridging visa right away? I don't want to have an issue with that and have to buy a plane ticket that same day! thanks for all the info.

I could be wrong, but if you're talking about buying your ticket on the day that your bridging visa is granted (as opposed to when your temp spouse visa is granted), you MAY have some issues with leaving the country. Obviously, jagkiharra could tell you more about that! :)

BTW, did you see my post in the other thread?

if my bridging visa was granted I wouldn't need to buy a ticket. I just wasn't sure if it was granted right away while they look over the temp. partner visa. We have to go in just about when my whv will expire and I wanted to make sure I would be able to stay here while they are making a decision. I will check out your other thread right now thanks so much!

They are generally very strict about the 12 month requirement. If you can only prove 12 months minus one day, your application will get rejected. So if you do decide to file, make sure that you're evidence from day one is solid. The application fee on this one isn't cheap.

The bridging visa is granted as soon as the application is received. To get an idea where you exactly stand, you should check:

The exact date when you complete 12 months of your relationship
The exact date of your current visa expiry
Any public holidays, Saturday or Sunday towards the end when you are applying

As long as you have evidence that your application was accepted while your current visa was valid, you will automatically get a Bridging Visa and won't have to leave the country.

Hey,I am currently on 1 year tourist visa and i am allowed to do multiple travels to australia with maximum stays for each visit not more than 3 months. I submitted my applications for partner visa yesterday and my tourist visa is expired on september the 29th 2010. I went home a month ago and then flew back to melbourne on the 12th of August. They said i will automatically get a bridging visa after the 12th of November 2010. I always thought no matter what, my current visa is going to expired on september the 29th 2010 but apparently, that is not how it works. I am not allowed to enter the country after the 29th of september but my visa is still going to be valid 3 months after my date of arrival (so if i arrived in the country on the 29th of september my current visa is going to be valid until the 29th of november). I thought I will share this information in case any of you didn't know about it. But yeah, I am pretty sure that you are going to get bridging visa soon as your current visa expired if you got all your applications submitted before your current visa expired.
