Hi guys,

I posted a topic here a while back (long forgotten) and I appreciated all the help I received. Anyway, I wanted to find out if anyone knew about the Partner Visa waivers, primarily regarding the evidence of relationship and PR eligibility.

We do have a substantial amount of evidence towards our relationship, most being our son; as well as too many pictures, notes, invites, letters - but not so much in form of bills or statements. Will that be a big issue? (We have kept our finances fairly separate outside of grocery.) Is there anyone who has had a similar issue regarding documentation?

I would think our marriage + son (we married in NSW) is a significant but incomplete factor. That being said if we WERE to be found to be well evidenced...how would it affect my residency status?

However, you may be granted a permanent visa without having to wait if you can demonstrate one of the following:

at the time you apply for the visa, you have been in a married or de facto relationship with your partner for three years or more.
at the time you apply, you have been in a married or de facto relationship with your partner for two years or more, and there is a dependent child of your relationship."

It seems to me that I would be essentially eligible for PR immediately if everything went smoothly. (Note: I have been with my wife since August 2007, married since March 2010, our son was born in December 2008, but I have been back and forth between the US and Aus three times since 2007.)

If anyone has experience with these situations please respond. Or anyone who feels like commenting for that matter. Ultimately, I'm motivated to finally stay with my family.

Thanks all!
